In the “GOOD WOOD” Trademark and Logo Registration Refusal Case, the China National Intellectual Property Administration (CNIPA) ruled that the opposed party, Daqing Lubricant Company, had filed the trademark application without authorization, thereby infringing upon the prior copyright held by the opposer, Goodwood Estate. As a result, the registration of the “GOOD WOOD” trademark and logo was denied. The case underscores the critical balance trademark law maintains between trademark rights and prior rights.
