The China National Intellectual Property Administration issued the Measures for Mediation of Disputes over the Implementation of Patent Opening License (for Trial Implementation)
The Measures consist of five chapters and thirty articles that clarify the content of case acceptance, case mediation, and settlement of disputes over patent open licensing implementation. |

(1) General provisions: provides the legal basis and working principles of dispute mediation in patent open licensing implementation. (2) Case acceptance: clarifies the acceptance conditions for patent open license implementation dispute mediation applications, the registration of acceptance, and so on. (3) Case mediation: specifies the procedures for appointing mediators, the number of mediators, the circumstances in which they should recuse themselves, and so on. (4) Closing the case: clarifies the circumstances for signing the mediation agreement, the main content, the effective conditions of the mediation agreement, and so on. (5) The supplementary provisions: clarifies the power of interpretation and the effective date of the Measures.
2、 Entertainment Law
Hangzhou Internet Court issued the Guidelines on Legal Risk Prevention of Online Live Broadcasting Marketing Behavior and the Guidelines on Legal Risk Prevention of Intellectual Property Protection in the Online Live Broadcasting Industry
The "Guidelines for Live Streaming Marketing" regulate the live streaming sales behavior of three types of entities: live streaming marketing platforms, live streaming marketers, and product operators.
The "Intellectual Property Guidelines" require live streaming marketing platforms to ensure that the participating entities hold relevant qualifications and licenses and to review the qualifications and identities of the hosts. The platform needs to regulate live streaming content, prevent the publication of illegal information, protect virtual property and personal data, and so on. |
